These Terms and Conditions set out the basis on which we provide waste collection services in and around Colliers Wood. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing any booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings given below:

Customer means the person, business, or organisation booking or receiving waste collection services.

Services means the waste removal, collection, loading, transportation, and related services provided by us.

Waste means the items, materials, rubbish, or refuse that the Customer requests us to remove, subject to applicable waste regulations.

Service Area means the locations within which we provide services, including Colliers Wood and surrounding local areas, as specified by us from time to time.

Contract means the agreement between us and the Customer for the provision of services, incorporating these Terms and Conditions.

2. Scope of Services

We provide waste collection and related services for domestic, commercial, and other approved premises within our service area. The exact scope of services for each booking will be described at the time of booking based on the information provided by the Customer.

Our services may include collection of household waste, bulky waste, garden waste, light construction waste, and commercial waste, subject always to applicable waste and environmental regulations and to any exclusions we notify to the Customer.

We reserve the right to refuse to collect any waste that we reasonably believe is hazardous, prohibited, incorrectly described, unsafe to handle, or not compliant with relevant regulations or our licence requirements.

3. Booking Process

3.1 Bookings can be made by phone, email, or through any online booking system we may provide. The Customer must provide accurate and complete information about the type, approximate volume, and location of waste, as well as access details and any restrictions affecting collection.

3.2 Any quotation provided before inspection is based on the information supplied by the Customer and is indicative only. We may adjust the price at the time of collection if the actual volume, weight, type of waste, or access conditions differ from what was stated at the time of booking.

3.3 A booking is only confirmed when we have accepted it and provided a confirmation by email, text message, or other written form. We reserve the right to decline any booking at our discretion.

3.4 The Customer is responsible for ensuring that an authorised person is available at the premises at the agreed time to grant access, provide any necessary instructions, and confirm the waste to be collected.

4. Access and Collection Conditions

4.1 The Customer must ensure safe and reasonable access to the waste for our staff and vehicles. This includes ensuring that driveways, entrances, and internal routes are clear, that parking or loading permissions are in place where needed, and that any entry codes or keys are provided.

4.2 If we are unable to complete or start the service due to inadequate access, incorrect information, or the absence of an authorised person, we may charge a call-out fee or a reasonable proportion of the service fee to cover our costs.

4.3 We may, at our discretion, refuse to undertake any collection or remove any item where we reasonably believe that doing so would be unsafe, unlawful, or likely to cause damage to property or persons.

5. Pricing and Quotations

5.1 Prices for waste collection in Colliers Wood and the wider service area are usually based on the type and volume of waste, access conditions, labour time, and disposal charges. We may also apply minimum load charges, congestion or parking costs, and surcharges for particular waste streams.

5.2 Any quotation given prior to physical inspection of the waste is an estimate only. The final price will be confirmed on site before the service is carried out, once we have assessed the actual waste and conditions.

5.3 If the Customer does not agree to any revised price advised on site, we will not be obliged to proceed with the service. In such circumstances we may charge a reasonable attendance fee to cover our time and costs.

6. Payments

6.1 Unless we have agreed credit terms in writing, payment is due immediately on completion of the collection, and before we leave the site. We may accept payment by cash, debit or credit card, bank transfer, or other methods as communicated by us from time to time.

6.2 For account customers or commercial clients with agreed credit terms, invoices must be paid in full within the payment period stated on the invoice. If no period is specified, payment is due within 14 days of the invoice date.

6.3 If the Customer fails to pay any amount due, we reserve the right to charge interest on the overdue amount at the statutory rate applicable in England and Wales and to recover any reasonable costs incurred in attempting to recover the debt.

6.4 We reserve the right to suspend or cancel further services to any Customer with outstanding payments or overdue invoices.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a booking by giving us reasonable notice in advance of the scheduled collection time.

7.2 For standard residential or small commercial bookings, cancellations or changes made more than 24 hours before the scheduled time will normally be free of charge. If cancellation or significant changes are made less than 24 hours before the booking, we may charge a cancellation fee to cover our costs.

7.3 For larger jobs, multiple vehicle bookings, or work scheduled outside normal hours, we may apply specific cancellation terms, which will be notified at the time of booking.

7.4 If we need to reschedule or cancel a booking due to operational reasons, severe weather, vehicle breakdown, staff illness, or circumstances beyond our control, we will notify the Customer as soon as reasonably practicable and offer an alternative appointment. We will not be liable for any loss arising from such rescheduling or cancellation, other than refunding any prepaid amounts for services not delivered.

8. Customer Responsibilities

8.1 The Customer is responsible for accurately describing the waste and for ensuring that no hazardous, prohibited, or mislabelled materials are presented for collection unless we have expressly agreed in writing and appropriate arrangements are in place.

8.2 The Customer must separate waste streams where required by law or by us for regulatory, safety, or recycling reasons. This may include separating electrical items, batteries, chemicals, or other specific categories of waste.

8.3 The Customer shall ensure that any personal data or confidential materials are removed or destroyed before disposal. We accept no responsibility for the loss, disclosure, or misuse of any data or documents contained within waste collected from the Customer.

9. Waste Regulations and Compliance

9.1 We operate in accordance with applicable UK waste and environmental laws and regulations. We will only transfer waste to authorised facilities and will keep appropriate records, including waste transfer notes, where required.

9.2 By engaging our services, the Customer warrants that they have the authority to transfer the waste to us and that the waste is lawfully held and does not contravene any applicable law.

9.3 The Customer acknowledges that certain items, such as hazardous waste, electrical equipment, chemicals, asbestos, medical waste, and other regulated materials, may be subject to additional requirements or may not be accepted at all. The Customer must declare such items at the time of booking.

9.4 If we discover that waste collected from the Customer includes prohibited, hazardous, or misdescribed materials, we may take any necessary steps to comply with the law, including returning the waste, arranging for specialist disposal, or notifying the relevant authorities. The Customer will be responsible for any additional costs, fines, or liabilities arising from such non-compliance, except to the extent caused by our own negligence or breach of duty.

10. Title and Risk in Waste

10.1 Title to the waste transfers to us at the point it is loaded onto our vehicle, provided that the waste is lawful to possess and dispose of. If the waste is subsequently found to be unlawful or misdescribed, we may treat the transfer of title as void and require the Customer to accept return of the waste or to bear the costs of lawful disposal.

10.2 Risk in the waste passes to us when it is safely loaded onto our vehicle. Up until that point, the waste remains at the Customer's risk.

11. Liability and Limitations

11.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded under applicable law.

11.2 Subject to the above, we will not be liable for any loss of profit, loss of business, loss of data, loss of goodwill, or any indirect or consequential loss arising out of or in connection with the provision of our services or these Terms and Conditions.

11.3 Our total liability to the Customer in respect of any claim arising under or in connection with the services or these Terms and Conditions, whether in contract, tort, or otherwise, shall be limited to the amount paid or payable by the Customer for the specific service from which the claim arises.

11.4 The Customer is responsible for removing or protecting fragile items, furnishings, or surfaces that may be affected by the collection. We will take reasonable care, but we will not be liable for fair wear and tear, or for minor cosmetic damage that is reasonably incidental to the proper performance of the services.

12. Insurance

We maintain appropriate public liability and employer's liability insurance in connection with our waste collection operations. Details of our insurance cover can be made available upon reasonable request.

13. Events Beyond Our Control

We will not be in breach of these Terms and Conditions or liable for any delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances, or causes beyond our reasonable control. This may include extreme weather, accidents, road closures, strikes, equipment failure, or regulatory changes. In such circumstances we will endeavour to resume the services as soon as it is reasonably practicable.

14. Complaints

If the Customer has any concerns or complaints about our waste collection services, they should contact us as soon as possible with full details. We will investigate the issue and aim to resolve it promptly and fairly. Raising a complaint does not affect the Customer's obligation to pay any undisputed charges.

15. Variation of Terms

We may update or amend these Terms and Conditions from time to time, for example to reflect changes in the law, regulatory requirements, or our business practices. Any updated terms will apply to new bookings made after the date on which the revised terms are published or otherwise notified to the Customer. The terms in force at the time of booking will apply to that booking.

16. Data Protection

We will handle any personal information provided by the Customer in accordance with applicable data protection laws. Personal data will be used for purposes connected with providing the services, administering the contract, handling payments, and complying with legal obligations.

17. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services provided under them.

18. Severability

If any provision or part-provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or competent authority, that provision or part-provision shall, to the extent required, be deemed deleted, and the validity and enforceability of the remaining provisions shall not be affected.

19. Entire Agreement

These Terms and Conditions, together with any written quotation or confirmation of booking issued by us, constitute the entire agreement between us and the Customer in relation to the provision of waste collection services in the service area, including Colliers Wood. The Customer acknowledges that they have not relied on any statement, promise, or representation made or given by or on behalf of us which is not set out in these Terms and Conditions or in writing at the time of booking.
